MRC Alert Special: Worst New York Times Bias of the Year

Media Research Center CyberAlert Newsletter
December 16, 2009 14:41 ET

The Times Watch Quotes of Note: 2009 Worst Quotes of the Year

New York Times bias often came with a smile in the early part of 2009, with the paper falling hard for Obama's “historic” presidency and limitless intellect. But by late summer that smile had curdled into a snarl, as Times reporters seethed at “angry,” “bitter,” and, above all, “white” tea party protesters who challenged the President on his attempted takeover of health care and his massive spending proposals.

For the worst bias the Times had to offer in 2009 in five categories, as compiled by Clay Waters for the MRC's TimesWatch site:
http://www.mediaresearch.org/timeswatch/articles/2009/20091216112245.aspx

But first, the worst three New York Times quotes of the year as selected by three expert observers of the New York Times: This year Times Watch welcomes first-time judge Scott Johnson to join Thomas Lifson and Don Luskin to choose the most biased quotes as their “favorite” from the Times in 2009.

# Scott Johnson of the Powerline blog went beyond the call of duty and may qualify for hazard pay, picking favorites in each category. But he found this quote from Thomas Friedman's September 9 column in praise of Communist China the worst of all:

“Watching both the health care and climate/energy debates in Congress, it is hard not to draw the following conclusion: There is only one thing worse than one-party autocracy, and that is one-party democracy, which is what we have in America today. One-party autocracy certainly has its drawbacks. But when it is led by a reasonably enlightened group of people, as China is today, it can also have great advantages.”

Johnson observed: “Given the esteem in which he is held by 'right' (as in left) thinkers, Tom Friedman deserves special recognition for this quote. It sheds light on Friedman, the Times, and Times readers.”

# Thomas Lifson, editor and publisher of American Thinker, picked this September 13 quote from columnist Maureen Dowd:

“Surrounded by middle-aged white guys -- a sepia snapshot of the days when such pols ran Washington like their own men's club -- Joe Wilson yelled 'You lie!' at a president who didn't. But, fair or not, what I heard was an unspoken word in the air: You lie, boy!”

Lifson commented: “Maureen Dowd’s imputing of racism to Rep. Joe Wilson, in her infamous 'You lie, boy!' fantasy is not merely repulsive, it reveals a mind alarmingly detached from reality. The sheer meanness and casual flinging of a scurrilous charge plumb a moral low.”

# Don Luskin, chief investment officer of Trend Macrolytics LLC and publisher of The Conspiracy to Keep You Poor and Stupid, picked the paper's double standards on unions, which are vital institutions -- for other businesses. For the New York Times itself? Not so much:

“The argument against unions -- that they unduly burden employers with unreasonable demands -- is one that corporate America makes in good times and bad....The real issue is whether enhanced unionizing would worsen the recession, and there is no evidence that it would. There is a strong argument that the slack labor market of a recession actually makes unions all the more important.” -- Editorial from Dec. 29, 2008.

vs.

“The New York Times News Service will lay off at least 25 editorial employees next year and will move the editing of the service to a Florida newspaper owned by The New York Times Company....The plan for the news service calls for The Gainesville Sun, whose newsroom is not unionized and has lower salaries, to take over editing and page design.” -- Richard Perez-Pena, Nov. 13, 2009.

Luskin said this double standard “expresses the fundamental hypocrisy of the Times as an elite institution that tries to establish its institutional legitimacy by attacking elite institutions.”

For all the quotes, check online where you can read the worst bias in five categories:

– WE LOVE OBAMA...

– ...AND WE HATE CONSERVATIVES

– SAM TANENHAUS, UNDERTAKER FOR CONSERVATIVE MOVEMENT

– PRO-DEMOCRATIC DOUBLE STANDARDS

– JUST PLAIN WACKY

Dick Armey to Protesters: 'I've Never Seen So Many Attractive Domestic Terrorists'
Washington (CNSNews.com)
- Hundreds of people dressed in red and carrying American flags gathered outside the U.S. Capitol on Tuesday to protest the Senate health care bill, chanting "kill the bill" and calling for the impeachment of President Barack Obama, Senate Majority Leader Harry Reid, and House Speaker Nancy Pelosi. Speakers at the "Code Red Rally" said the Senate health care bill tramples on the Constitution, infringes on personal liberty, rations care for the elderly and uses taxpayers' money to pay for abortion.

He said "court-martialing three SEALs for maybe or maybe not punching some guy in the stomach without any kind of corroborating evidence I don't think is sending the right message."

Sen. Lieberman Says Government Makes People Pay For Things They Think Are Immoral 'All the Time'
Washington (CNSNews.com)

Lieberman told CNSNews.com, "it happens all the time because we put money into a general pot and then it goes to things that some people support and some don't."

Boxer Backs 'Hyde Idea' To Bar Federal Funds For Abortion, But Voted Against Hyde-Like Language In Health Care Bill
Washington (CNSNews.com)
– When asked about the health care bill and taxpayer-funding of health plans that cover abortion, Sen. Barbara Boxer (D-Calif.) said on Monday that she supports the Hyde amendment, which prohibits federal funds from paying for abortion except in cases of rape, incest, or to save the life of the mother. But a week ago, Boxer voted against an amendment sponsored by Sen. Ben Nelson (D-Neb.) that would have added language virtually identical to the Hyde amendment to the Senate health care bill.

COMMENTARY

An Unhealthy Bill
By Rich Galen
There is no "public option" provision in the Senate bill. At least not yet. But wait until House-Senate negotiators get done with it. The real mischief will happen in conference committee.

Unchurched, Unmarried, Poor, Inexperienced and Pro-Obama
By Terence P. Jeffrey
A strategist casting a cold eye on the Gallup poll tracking President Barack Obama's job approval rating might be tempted to give our president the following advice: Sir, you need more unmarried, unchurched, poor and inexperienced Americans. Given the polling trends, the more people who are devout, married and prosperous and have seen more than a few decades of life, the worse it will be for the president.

Obama Brings the Gitmolympics Home
By Michelle Malkin
President Obama's hometown cronies lost their bid to bring the 2016 Olympic Games to the Windy City. But this week they got a consolation prize: They'll bring the Guantanamo Bay terrorists to Illinois. Call it the Gitmolympics. Team Obama is now championing the very same indefinite detention powers for which it condemned the Bush administration.

Paying Off 'La Raza'
By Ben Shapiro
If you were president of the United States, would you hire an alleged former spy for Fidel Castro to be ambassador to El Salvador, a country teetering on the brink of hard-core socialism? President Obama just did. Why would Mari Del Carmen Aponte escape the Obama administration's scrutiny? Because she is a former board member of the National Council of La Raza, the largest Hispanic advocacy organization in U.S. The Obama administration has consistently sought the group's approval…

Tracking Liberal Media Bias Since 1996
Wednesday December 16, 2009 @ 10:31 AM EST

1. CBS Relays Liberal Anger 'Their Agenda is Being Hijacked by a Few'
A night after MSNBC's Keith Olbermann demanded Senator Joe Lieberman "just resign already" as he shrieked "you are embarrassing humanity!", CBS joined in targeting Connecticut's "independent Democrat" for daring to oppose liberals on health care. “He holds the 60th vote needed to get the health care reform bill passed in the Senate," anchor Katie Couric intoned, "and Nancy Cordes tells us supporters of reform are angry and confused about Lieberman's position." Cordes soon expanded the exasperation to include "Democratic Senators Mary Landrieu, Blanche Lincoln and Ben Nelson" who "successfully blocked the public option even though the other 55 Democrats support it. Nelson is still holding out for stricter anti-abortion language, leading some liberals to complain their agenda is being hijacked by a few." She demanded of Lieberman: "Does it trouble you that you're going against an overwhelming majority of your caucus?"

2. MSNBC Graphics Fret About Joe Lieberman, 'The Spoiler' Who Is 'Blowing' Health Care Reform
Some of the clearest examples of MSNBC's liberal bias can be found in the onscreen graphics selected for the network's programming. In the span of 20 minutes on Tuesday, three such Morning Meeting images stated a pretty clear opinion about Joe Lieberman's opposition to parts of the health care bill. At 9:20am, one whined, "Joe Blowing Health Reform?"

3. CNN's Gergen Likens President Obama to Damsel in Distress
CNN's David Gergen played up the difficulties that President Obama has faced on Monday's Anderson Cooper 360, underscored the importance of the coming week for the executive, and compared him to an iconic movie damsel in distress: "For a president who's had more trials than anybody I can remember in a long time, sort of 'The Perils of Pauline' all year, this has become a climactic week for his presidency." Host Anderson Cooper brought on the senior political analyst to comment on the latest development on the health care debate, the Obama presidency in his first months, and the President's upcoming trip to the UN’s climate change conference in Copenhagen. Cooper first asked Gergen about the potential for congressional liberals to turn against the proposed health care "reform" bill if the Obama administration cuts a deal with Senator Joe Lieberman over his objections to a Medicare "buy-in" for people 55 and older: "So, David, dropping the Medicare buy-in, could we be seeing- I mean, a liberal revolt in the wake of this? Because, I mean, a lot of people haven’t been following the minutia of this, but, basically, that idea of expanding Medicare to 55 and above, that was all for liberals, who were angered over the public option being dropped out."

4. ABC's Martin Bashir Attacks 'Brutal Regime' of Sheriff Joe Arpaio, Assails 'Racial Profiling'
On Monday's Nightline, co-host Martin Bashir conducted a one-sided, hostile profile of Sheriff Joe Arpaio's "brutal regime" and attacked his crackdown on illegal immigration as "racial profiling." The 11 minute investigation of the Maricopa County law enforcement official was almost totally negative.

5. Ex-CBS Anchor Dan Rather Worried About 'Accountability' of Internet Journalism
In a Monday interview on MediaBistro.com’s weekly video series Media Beat, disgraced former CBS Evening News anchor Dan Rather shared his concerns over the credibility of internet journalism: “The difficulty with some of the things on the internet...is transparency and accountability about who’s responsible for what’s on.”

6. Pelosi Finishes Last Among Today Viewers' Choice for Person of the Year
In advance of Time magazine's Person of the Year choice being revealed on Wednesday’s show, NBC's Today show brought on managing editor Richard Stengel yesterday, to reveal the seven finalists, and on Tuesday's show NBC's Matt Lauer and Meredith Vieira gave the results of an on-line poll of their viewer's picks and it wasn't good news for Nancy Pelosi. The Speaker of the House finished dead last among the seven candidates but Lauer pitied Pelosi as he cheered on: "C'mon Nancy you can do better."

CBS Relays Liberal Anger 'Their Agenda is Being Hijacked by a Few'

A night after MSNBC's Keith Olbermann demanded Senator Joe Lieberman “just resign already” as he shrieked “you are embarrassing humanity!”, CBS joined in targeting Connecticut's “independent Democrat” for daring to oppose liberals on health care. “He holds the 60th vote needed to get the health care reform bill passed in the Senate,” anchor Katie Couric intoned, “and Nancy Cordes tells us supporters of reform are angry and confused about Lieberman's position.”

Cordes soon expanded the exasperation to include “Democratic Senators Mary Landrieu, Blanche Lincoln and Ben Nelson” who “successfully blocked the public option even though the other 55 Democrats support it. Nelson is still holding out for stricter anti-abortion language, leading some liberals to complain their agenda is being hijacked by a few.” She demanded of Lieberman: “Does it trouble you that you're going against an overwhelming majority of your caucus?” (Hard to imagine a CBS reporter ever scolding a more liberal Republican for defying the party's conservative majority.)

A frustrated Cordes concluded: “So this small group of four or so Senators has managed successfully to impose their will on the other 530 members of Congress because the changes that they're demanding to the Senate bill will likely have to be made to the House bill, too.”

Earlier in the story, Cordes delivered the blogosphere/MSNBC attack line against Lieberman:

The proposal to allow younger Americans to buy into Medicare had been crafted specifically as a compromise for Lieberman and other moderates who had opposed a public option. The Connecticut Senator has championed the buy-in idea for nearly a decade, and reiterated his support just three months ago....What's especially mystifying, Senators say, is that Lieberman has historically sided with liberals on domestic issues.

The MRC's Brad Wilmouth corrected the closed-captioning against the video to provide this transcript of the story on the Tuesday, December 15 CBS Evening News:

KATIE COURIC: Now, more about the Senator Chip [Reid] mentioned in his report, independent Joe Lieberman of Connecticut. As Chip said, he holds the 60th vote needed to get the health care reform bill passed in the Senate, and Nancy Cordes tells us supporters of reform are angry and confused about Lieberman's position.

NANCY CORDES: Even close colleagues of Senator Joe Lieberman were at a loss today to explain his apparent about-face.

SENATOR DEBBIE STABENOW (D-MI): I have no idea.

CORDES: After all, the proposal to allow younger Americans to buy into Medicare had been crafted specifically as a compromise for Lieberman and other moderates who had opposed a public option. The Connecticut Senator has championed the buy-in idea for nearly a decade, and reiterated his support just three months ago.

SENATOR JOSEPH LIEBERMAN (I-CT): What I was proposing was that they have an option to buy into Medicare early.

CORDES: But this week he suddenly threatened to block the health care bill if it contains a Medicare buy-in, throwing the entire process into disarray yet again.

SENATOR SHERROD BROWN (D-OH): I'm very disappointed because I thought we had Senator Lieberman's staff in the room, I thought we were gonna, during the negotiations, I thought he would go along with it.

CORDES: What's especially mystifying, Senators say, is that Lieberman has historically sided with liberals on domestic issues, even though he became an independent in 2006 after losing his Democratic primary.

JIM SHEA, THE HARTFORD COURANT: No one can understand exactly what Joe's up to with this. You know, there's some people that think he's, you know, that he's grandstanding. There's some people who think he's, you know, kowtowing to the insurance industry.

CORDES: The industry does have a large presence in Connecticut and gives generously to his campaigns. But Lieberman is hardly the only moderate putting the brakes on the bill. Democratic Senators Mary Landrieu, Blanche Lincoln and Ben Nelson – who come from conservative states – successfully blocked the public option even though the other 55 Democrats support it. Nelson is still holding out for stricter anti-abortion language, leading some liberals to complain their agenda is being hijacked by a few.

CORDES TO LIEBERMAN: Does it trouble you that you're going against an overwhelming majority of your caucus?

LIEBERMAN: Well, it's not fun. I said that to my colleagues at the White House. I haven't enjoyed it. But you've got to do what you think is right.

CORDES: So this small group of four or so Senators has managed successfully to impose their will on the other 530 members of Congress because the changes that they're demanding to the Senate bill will likely have to be made to the House bill, too. Katie?

COURIC: And, Nancy, how does Senator Lieberman explain that he supported allowing people to buy into Medicare as recently as September?

CORDES: Well, he insisted today that he hasn't flip-flopped, the that the Medicare-buy in is something that he supported years ago back when the economy was better than it is now before there was another health care reform bill that does so many things to make health insurance affordable for older people.

COURIC: Meanwhile, Nancy, as you mentioned, there are plenty of Senate Democrats who feel very strongly about a public option. Could their support be lost if there isn't one in the bill?

CORDES: Well, there are a couple of Senators – Senator Roland Burris of Illinois or Bernie Sanders of Vermont – who say it would be very difficult for them to support a bill if it doesn't contain a public option? But they stopped short of drawing a line in the sand the way that Senator Joe Lieberman did so it does look like there is some wiggle room there.

MSNBC Graphics Fret About Joe Lieberman, 'The Spoiler' Who Is 'Blowing' Health Care Reform

Some of the clearest examples of MSNBC’s liberal bias can be found in the onscreen graphics selected for the network’s programming. In the span of 20 minutes on Tuesday, three such Morning Meeting images stated a pretty clear opinion about Joe Lieberman’s opposition to parts of the health care bill. At 9:20am, one whined, "Joe Blowing Health Reform?"

At 9:01, another graphic actually used an exclamation point, not often seen in supposedly objective reporting: "Say It Ain’t So, Joe! Lieberman: No on Buy-In." At 9:14, a picture of the senator appeared onscreen with the words "THE SPOILER."

At 9:20, host Dylan Ratigan interviewed Ned Lamont, the Democratic candidate that liberals supported in the 2006 primary against the Connecticut Senator. Fellow guest Jonathan Capehart, the liberal editorial writer for the Washington Post, mused about less honorable reasons as to why Lieberman might oppose lowering the age of Medicare.

He speculated, "Mr. Lamont, can you put to rest one thing I've seen in the press? and that is maybe one of the reasons why Senator Lieberman is flip-flopping all over the place on this is because of the insurance interests in Connecticut. Do you think that that is a valid point or a valid criticism?"

In an earlier tease for the segment, Ratigan wondered if this was "revenge" on the part of Lieberman. Clearly, MSNBC is not happy with the possibility that Lieberman could derail or water down the possibility of government-run health care.

A transcript of the December 15 segment, which aired at 9:20am EST, follows:
9:01 graphic: Say It Ain’t So, Joe! Lieberman: No on Buy-In

9:14 graphic [Over picture of Lieberman]: The Spoiler

9:20 graphic: Joe Blowing Health Reform?

9:20

[Clips of Lieberman earlier saying he would reserve judgment on the expansion of Medicare.]

DYLAN RATIGAN: So you can see why many Democrats this morning are boiling with rage, pondering Lieberman's sudden about-face. Some are even asking the question, could it have anything to do with this man? Joining the Morning Meeting is Ned Lamont, who challenged Lieberman in 2006 for the U.S. Senate, and won, prompting Lieberman to leave the Democratic party. Lamont now exploring a run for governor. Also with us, Jonathan Capehart, Washington Post editorial writer. And Mr. Lamont, why do you think Senator Lieberman is making the decisions he's making right now?

NED LAMONT: Well, good morning, Dylan. Great to be with you. Look, I thought enator Lieberman made sense about the Medicare buy-in in 2004. During our campaign in 2006, he thought it was a good idea. You know, this is a state that is dead last in job creation and has some of the highest health care costs in the country. And the two are related. If you believe in job creation and growth, you've got to work on the health care costs. And as you pointed out just a few months ago, he reiterated his interest in this.

RATIGAN: But, why, why do you think the decision now, because again, Senator Klobuchar was just here, made a valid point. Listen, one of the issues of expanding Medicare without reforming some aspect of the pricing mechanism, where the pricing that you get as a doctor in Florida is very different than the pricing you get in Minnesota. And I’m not even sure that that’s Senator Lieberman's issue, but my point is there could be valid reason to talk about how you want to do this. I'm curious whether you feel like you have any insight as to whether Senator Lieberman's motives are those or are they more political, more gamesmanship?

LAMONT: I think he loves being in the cat bird seat , he loves being the 60th vote, loves having President Obama and others come to him. Look, there's no question that Medicare needs reform. And, you know, Senator Klobuchar's point that it's much more expensive in Miami than it is in Minnesota bears looking at. But, we do have folks, 55 to 65, that desperately need health insurance. It brings down costs for small businesses if they can buy in. We ought to support it. And something else Senator Klobuchar said, we're getting closer to the goal line. It's tough when Senator Lieberman keeps moving the goal line.

RATIGAN: Jonathan Capehart?

JONATHAN CAPEHART: Yeah. Mr. Lamont, can you put to rest one thing I've seen in the press? and that is maybe one of the reasons why Senator Lieberman is flip-flopping all over the place on this is because of the insurance interests in Connecticut. Do you think that that is a valid point or a valid criticism?

LAMONT: Look, I sure hope not. I would like to think that Senator Lieberman is doing it for principled reasons. But there's no question that he's been all over the map on this and we have a strong health care insurance industry here in the state. But, I think he's got to listen to all the people of the state of Connecticut, because most of us feel strongly that the Medicare buy-in is a reasonable compromise that will bring down health care costs for all of us.

RATIGAN: All right. Ned, a pleasure. Thanks for giving us a moment of your morning. Ned Lamont talking health care out of Connecticut.

CNN's Gergen Likens President Obama to Damsel in Distress

CNN’s David Gergen played up the difficulties that President Obama has faced on Monday’s Anderson Cooper 360, underscored the importance of the coming week for the executive, and compared him to an iconic movie damsel in distress: “For a president who’s had more trials than anybody I can remember in a long time, sort of ‘The Perils of Pauline’ all year, this has become a climactic week for his presidency.”

Host Anderson Cooper brought on the senior political analyst to comment on the latest development on the health care debate, the Obama presidency in his first months, and the President’s upcoming trip to the UN’s climate change conference in Copenhagen. Cooper first asked Gergen about the potential for congressional liberals to turn against the proposed health care “reform” bill if the Obama administration cuts a deal with Senator Joe Lieberman over his objections to a Medicare “buy-in” for people 55 and older: “So, David, dropping the Medicare buy-in, could we be seeing- I mean, a liberal revolt in the wake of this? Because, I mean, a lot of people haven’t been following the minutia of this, but, basically, that idea of expanding Medicare to 55 and above, that was all for liberals, who were angered over the public option being dropped out.”

The analyst immediately launched into his movie analogy about Obama:

GERGEN: Let’s put this in a larger context, first, Anderson. For a president who’s had more trials than anybody I can remember in a long time, sort of ‘The Perils of Pauline’ all year, this has become a climactic week for his presidency in his first year, because he has to deal with the bankers. He’s got to- he’s desperately trying now to rescue health care and save that, and he’s going to Copenhagen at the end of the week and that potential treaty is also going south. He has got to rescue that.

Gergen’s line mirrors that of President Obama and his administration, that, as he put it in his recent interview with Oprah Winfrey, “we have inherited the biggest set of challenges of any president since Franklin Delano Roosevelt.”

Later in the segment, the CNN anchor played a clip from that recent Oprah special, where the President also gave himself a “B-plus” grade for his performance in his first year in office, and asked, “So, he gives himself a B-plus, his approval ratings hitting a new low- I mean, is he trying to put a game face on a bad situation, or- I mean, does the White House perceive that there are successes on the brink?”

Gergen gave a more sober assessment, and brought up the results of CNN’s “Second 100 Days” feature from earlier this year, where 300,000+ people online gave Obama an overall “C-minus” grade (question #10 at the link):

GERGEN: They perceive that they have done better than the public thinks. You will remember, with the CNN- we had a big national vote here earlier this year, and people gave him less than a B-plus. And, Anderson, it’s really striking that last week, when he went to Oslo to receive the most prestigious prize in the world, the Nobel Peace Prize, at that very moment, his Gallup poll was at the lowest level of any president since Harry Truman at that time in his- in office. So, you know, he’s got this odd paradoxical situation, where he’s pulling off a Nobel Prize, but his ratings are real low. But here’s the deal: because this week is so climactic, if he can pull off health care, and if he can pull off Copenhagen at the end of the week, then the belief in the White House is, with unemployment already peaking, that he will be on the comeback trail, and the B-plus may be- or even an A-minus will be merited. But if either one of those or both fall apart, and he can’t get them, then B-plus is going to be way too generous.

The full transcript of the Gergen segment, which began 12 minutes into the 10 pm Eastern hour on Monday’s Anderson Cooper 360 program:

COOPER: Cracking down on Wall Street and passing health care reform were two key promises President Obama made while campaigning. But, tonight, as we said, big banks are poised to pay out huge bonuses once again, despite slashing their lending, and Senator Joe Lieberman is threatening to derail the Senate health care bill. It's fair to ask what all of this means for the President’s agenda and whether he’s lost control of it, frankly.

Many of our regular guests have unique access and inside knowledge about the stories of the day. Starting tonight, with senior political analyst David Gergen, we are going to be turning to them for an ‘Insider’s Briefing.’ So, David, dropping the Medicare buy-in, could we be seeing- I mean, a liberal revolt in the wake of this? Because, I mean, a lot of people haven’t been following the minutia of this, but, basically, that idea of expanding Medicare to 55 and above, that was all for liberals, who were angered over the public option being dropped out.

DAVID GERGEN: Yeah. Let’s put this in a larger context, first, Anderson.

Now, on this issue of health care, there’s no question that the liberal part of the Democratic Party is increasingly frustrated, angry at the process, because they thought they were going to get a public option. That was- became very central to them, but never central to Barack Obama- central to them. The moderates and centrists said, we don’t want to buy into this. So, the Senate came up and said- okay, instead of doing that, let’s have this Medicare buy-in. Look, Joe Lieberman even supported it some time ago. Lieberman turns against it over the weekend, very firmly. They’re short of the 60 votes, and tonight, they’re doing anything they can at the White House to salvage this, and the reports are they have been pushing Harry Reid to accept Lieberman’s change of heart, to drop Medicare, and I- there’s no sign- there’s nobody in the liberal ranks yet who has said he will break ranks, like a Russ Feingold, but that is potential. And Anderson, there’s also a potential here that the liberals are going to get angry at the President and the White House for not fighting harder to keep people corralled and get more of their views through.

COOPER: But, I mean- so, if he gets Lieberman on board by dropping this expansion of Medicare, they still need- what, Ben Nelson, and they need to figure out some language on abortion that Ben Nelson will support.

GERGEN: That’s right. They conceivably would- if they drop Medicare, could pick up support from Olympia Snowe.

COOPER: Okay.

GERGEN: She’s been very troubled by this Medicare proposal, and maybe they could get Ben Nelson. But, Anderson, there’s one more step in this. The liberals may have to accept in the Senate some form of the Stupak anti-abortion amendment before this over, in order to keep the House on board. So, there’s a - there are a lot of moving parts on this still, but it’s clear the White House is desperate to get to 60 votes this weekend. They are willing to drop darn near anything and move this bill to the right and strip it down of whatever it takes-

COOPER: And that’s because it-

GERGEN: In order to get those 60.

COOPER: That’s because it’s so essential now for the President to be able to say, I got health care reform, whether or not- almost no matter what it looks like at this point?

GERGEN: That’s exactly right. Now, in fairness to the White House, when they started this process, they never thought public option was very important. It’s not been part of the debate, frankly, about- the White House has been for universal access, and people are losing sight of it. This bill does provide near universal access. No president- seven presidents have tried this. None has succeeded. Barack Obama may succeed- insurance reform, some other important reforms. But, to the left, the public option, and, indeed the Medicare buy-in, was a dramatic step toward a single-payer system, which has been- you know, is very much an iconic proposal for a lot on the left-

COOPER: Yeah.

GERGEN: So, this is- the White House is sort of like trying to get a balloon up in the air and just throwing things over the side until you get a little- until you can get a little height on it.

COOPER: I want to play something that President Obama said to Oprah Winfrey last night in that special that aired last night. Let’s watch.

OPRAH WINFREY (from Christmas special with President Obama): What grade would you give yourself for this year?

PRESIDENT BARACK OBAMA: Good, solid B-plus.

WINFREY: A B-plus?

OBAMA: Yeah. I mean, I think that we have inherited the biggest set of challenges of any president since Franklin Delano Roosevelt.

COOPER (live): So, he gives himself a B-plus, his approval ratings hitting a new low- I mean, is he trying to put a game face on a bad situation, or- I mean, does the White House perceive that there are successes on the brink?

COOPER: Well, for me, that’s the takeaway from this interview, that this is the climactic week for the President on those three fronts-

GERGEN: Yeah.

COOPER: With the banks-

GERGEN: Yeah.

COOPER: With health care and Copenhagen. David Gergen, we will continue to watch it. Thanks.

ABC's Martin Bashir Attacks 'Brutal Regime' of Sheriff Joe Arpaio, Assails 'Racial Profiling'

On Monday’s Nightline, co-host Martin Bashir conducted a one-sided, hostile profile of Sheriff Joe Arpaio’s "brutal regime" and attacked his crackdown on illegal immigration as "racial profiling." The 11 minute investigation of the Maricopa County law enforcement official was almost totally negative. [Audio available here.]

After the Arizona sheriff asserted that his critics don’t like him because they oppose immigration endorsement, Bashir opined, "They don't like it because stopping people on the streets because they look Hispanic is racial profiling." In an interview with Newsmax, Arpaio claimed, "We've arrested and detained over 33,000 illegal aliens, 25 percent of the whole country..."

But rather than focus on successes, Bashir complained about the sheriff’s methods: "You're basically using minor misdemeanors, minor mistakes, perhaps speeding, as an excuse to then pick these individuals up?" The Nightline co-host aggressively focused on allegations of abuse. After bringing up claims of brutality and a botched prostitution ring, Bashir derided, "Doesn’t your brutal regime lead to brutality by your staff?"

The sheriff denied the insult and pointed out, "But you don’t talk about the great things we do in this organization."

Ignoring these points, Bashir reiterated his description of brutality and, almost incredulously, explained, "Brutal or not, the people of Maricopa County continue to elect him as the sheriff." Indeed, Arpaio was reelected by 13 points in 2008.

Certainly, it’s the job of a journalist to bring up allegations of abuse, should they exist. But Bashir seemed to have little interest in providing a balanced look into this sheriff.

A partial transcript of the December 14 segment can be found below:

11:48pm

MARTIN BASHIR: Sheriff Joe has 13 sweeps that have netted him more than 300 illegal immigrants and a slew of criticism.

SHERIFF JOE ARPAIO: They do not like me stopping illegal aliens on the streets, enforcing the laws. They don't like it. They don’t want that.

MARTIN BASHIR: They don't like it because stopping people on the streets because they look Hispanic is racial profiling.

ARPAIO: That's what they said, but we don't do that.

BASHIR: But, the United States government disagreed. This past October, the Department of Homeland Security removed his deputy’s right to enforce immigration laws on the streets, due to complaints of racial profiling. And the Department of Justice launched an investigation of his tactics. But, Sheriff Joe remained defiant.

ARPAIO: We are still going do what we have been doing in the last two, two and a half years. Nothing changes.

BASHIR: You’re basically using minor misdemeanors, minor mistakes, perhaps speeding, as an excuse to then pick these individuals up?

ARPAIO: No. We use minor misdemeanors to lock up dope peddlers, seize drugs, seize money, catch DUIs.

...

11:57

BASHIR: What do you think of the quality of your jail guards?

ARPAIO: My jail officers are great. I have full confidence in my staff, my deputy sheriffs.

BASHIR: The family of one man was awarded $6 million after he was forced into a restraint chair and died. And the suit was filed in federal court.

ARPAIO: I'm saying that our officers did nothing wrong. There were no criminal charges.

BASHIR: Another man was killed in a restraint chair. Got $8.5 million in a pre-trial settlement. What do think of the video that showed 14 guards beating, shocking and suffocating the prisoners?

ARPAIO: Well, I don't remember any eight million and six million. I do remember that as sheriff after 18 years, we’ve only paid out $8 million.

BASHIR: Did your office disguise vital evidence, including the crushed larynx of the man.

ARPAIO: That’s not true because that’s something the medical examiner has control.

BASHIR: There was a video beating him and shocking him. Are you proud of the behavior of the guards?

BASHIR: Are you proud of the behavior of those guards?

ARPAIO: My officers do the right thing. They had no criminal liability.

BASHIR: Where is the crushed larynx of the dead man?

ARPAIO: Have no idea.

BASHIR: His team of deputies and his so-called volunteer posse were also involved in a clamp down on prostitution but that wasn't without difficulties. Do you remember the 2003 drive to drive prostitution out of Maricopa County that you led?

ARPAIO: Yes.

BASHIR: Didn’t it backfire because some of your volunteers got naked on video and ended up having sex with the prostitutes?

ARPAIO: That is another, another erroneous report. That’s not true.

BASHIR: Isn’t that what happened? The county attorney says the reason it was impossible to press charges was because your volunteers were having sex with the people they were supposed to be arresting.

ARPAIO: Well, that’s not true. They were naked because I allowed them to take their clothes off to develop the case. That’s not unusual in this country. Yes.

BASHIR: So you allowed them to take their clothes off. Why did they end up having intimate relations?

ARPAIO: They had no sex. They had no sex. One time, one case that one of the women accidentally put her hand on one of our officers. One time. And that was it. Period. We did a great job.

BASHIR: Accidentally? So you just gone from say they did a brilliant job, now, you’re admitting they got naked. And now you saying the prostitute touched the genitals of one of your officers.

ARPAIO: I never denied that they got naked.

BASHIR: Some people say would suggest that when you’re the toughest sheriff in America and you lead by example in the way you have, it leads your officers to behave in some of the ways they have. People killed in restraint chairs. People having sex with prostitutes. Inmates abused and humiliated. Isn’t that what’s really going on here?

ARPAIO: That's ridiculous. We run a professional organization. I have been around 48 years. I’m not going to listen to the garbage in the papers for critics that you seem to be- I'm not blaming you- but you seem to be reading the history. But you don’t talk about the great things we do in this organization.

BASHIR: Doesn’t your brutal regime lead to brutality by your staff?

ARPAIO: I don't have a brutal regime.

BASHIR: Brutal or not, the people of Maricopa County continue to elect him as the sheriff. He’s now in his fifth term and there are no plans to retire and enjoy the peace and quiet of his home just outside Phoenix.

TVNewser.com columnist Gail Shister sparked the discussion by asking Rather: “Are you concerned at all that there is the absence of quality control when it comes to so much of the modern platforms?” Rather went on to fret: “...you can put something on the internet that’s really terrible about your neighbor or about a friend or a competitor and it’s almost impossible to find out who the source is. And you can say anything about them. That part of it troubles me.”

Rather of course ended his tenure at CBS after using fraudulent documents to smear President George W. Bush just days before the 2004 presidential election. He showed little concern for accountability and proper sourcing as he used fabricated memos to claim that Bush had gone AWOL while serving in the Texas Air National Guard in the 1970s.

On the September 10, 2004 Evening News, as evidence against the story mounted,  he lashed out at his critics: “Today, on the Internet and elsewhere, some people, including many who are partisan political operatives, concentrated not on the key questions of the overall story, but on the documents that were part of the support of the story.” It was internet journalists that held the mainstream media accountable and demanded transparency during the Rather-gate scandal.

Here is a transcript of the Media Beat exchange:

GAIL SHISTER: Is there such a thing as mainstream media anymore? What does that mean to you?

DAN RATHER: You know, I don’t know what it means anymore. If there is such a thing, I don’t what it is. I would love to have someone define it for me, but I don’t know what it is. Look, things change. And we’ve had great acceleration of change in television news and in journalism in general. And no one’s surprised by that change. And definitions change. One can make an argument that what’s on the internet now is mainstream, as opposed to what’s on the evening newscast.

SHISTER: But are you concerned at all that there is the absence of quality control when it comes to so much of the modern platforms? The so-called notion of citizen journalists, does that concern you in any way?

RATHER: Well, it does concern me, but overall, in the main, I think the development of what’s called citizen journalism is good, including that on the internet. The difficulty with some of the things on the internet, and I emphasize only some, some of the things, is transparency and accountability about who’s responsible for what’s on. As you know, you can put something on the internet that’s really terrible about your neighbor or about a friend or a competitor and it’s almost impossible to find out who the source is. And you can say anything about them. That part of it troubles me.

But look, there’s no question that we’ve moved into the internet age. And if it isn’t already, what’s on the internet is going to become the dominant source of news for most people. It’s not going to completely replace television, radio, and print, but it’s becoming the dominant source of news. Whether you like it or not, that’s a fact. So naturally we have some concerns about – I stated one of them – about accountability. But overall, in the main, I think it’s a force for good. I think it’ll continue to be – to grow. I think we’re no longer right on the first edge of it, but we’re not very far into what the internet is to become.

The following exchange was aired on the December 15 Today show:

MEREDITH VIEIRA: So who had the biggest impact on 2009? We're gonna reveal Time magazine's Person of the Year, live tomorrow on Today.

MATT LAUER: We gave you the seven contenders on Monday, and asked you to weigh in on-line. Here are the results as you can see. Steve Jobs leading the way with 49 percent. President Obama in second with 20 percent, followed by General Stanley McChrystal with 11 percent. The rest of the top seven are there.

(Graphic shows Usain Bolt at 10 percent, Chinese workers at 5.7 percent, Ben Bernanke at 3.3 percent, Nancy Pelosi last at 1.8 percent)

VIEIRA: Yeah my Ben Bernanke there, is way down at the bottom there.

LAUER: Uh huh. Nancy Pelosi with 1.8 percent. C'mon Nancy you can do better.

VIEIRA: It's interesting Jobs, I guess, because everybody, almost everybody has an iPhone or an iPod so they might think of him, you know, pretty much every day.

LAUER: He was recently named CEO of the Decade.

Good Morning Tri City, WED 16 Dec 2009
As GE officials have talked up their post-NBC M&A strategy over the past few weeks, they keep coming back to the one that got away -- French nuclear reactor maker Areva's transmission and distribution business. Areva in November decided not to accept bids from U.S. conglomerate General Electric Co or Japanese industrial Toshiba in favor of a bid from a French consortium, in a move that many saw as politically influenced.

GE Chief Executive Jeff Immelt told investors on Tuesday he was not surprised by that turn of events. "We were never naive about where Areva was going to go," Immelt said. "We were in but we were not stupid."

In-Depth Issues:

British Agent Exposed True Purpose of Iran's Qom Nuclear Facility - Ron Ben-Yishai (Ynet News)
Iran revealed its nuclear facility near Qom in late September after a British agent exposed its true purpose to the West, Ynet learned Tuesday.
American, British and Israeli satellites had documented construction work at the uranium enrichment site for years, but the West only learned of its true purpose from an MI-6 agent who was exposed by Iran.

Iran Raises Nuclear Tension with Missile Test Launch - Tim Reid (Times-UK)
Tehran claimed Wednesday to have successfully test-fired a medium-range Sejil-2 missile believed capable of reaching almost any target in the Middle East, including Israel, Iraq and several American military bases in the region.

Man Convicted in Seattle Jewish Center Shooting Spree - Levi Pulkkinen (Seattle Post-Intelligencer)
Naveed Haq, 34, was found guilty of aggravated murder Tuesday, with jurors unanimously rejecting claims of insanity raised by the defense.
In a July 28, 2006, shooting at the Seattle Jewish Federation, he killed Pamela Waechter and wounded Carol Goldman, Layla Bush, Dayna Klein, Christina Rexroad and Cheryl Stumbo.
King County Prosecutor Dan Satterberg described the attack as "our state's worst hate crime." Shooting survivor Carol Goldman said, "It was not insanity that led him to do this, it was hate that was in his heart."

Report: Albania Reships Arms from Ukraine to Hizbullah (Naharnet-Lebanon)
An Albanian opposition daily revealed on Dec. 2 the involvement of the Albanian government in facilitating the passage of Ukrainian arms to Hizbullah.
It said Albania bought "C 18" and "C 16"-type missiles using money from Iran, and the shipment was then transferred to Beirut.

Iranian Arms Trafficker Sentenced to Five Years - Sebastian Rotella (Los Angeles Times)
Amir Hossein Ardebili, 36, an Iranian arms trafficker, was sentenced in Delaware on Monday to five years in prison after being snared in a global undercover investigation.
He pleaded guilty last year to violating U.S. arms control laws by trying to purchase components for Iranian fighter planes and missile guidance systems.
Tips from American companies that deal in electronic technology with potential military uses brought Ardebili to the attention of U.S. investigators. His exclusive client, according to court documents, was the Iranian government.
"He sent thousands upon thousands of solicitations to U.S. companies, requesting quotes [on] tens of thousands of components, many used in military applications," court documents said.

News Resources - North America, Europe, and Asia:

  • U.S. House of Representatives Approves Iran Gasoline Sanctions
The House of Representatives approved legislation on Tuesday in a 412-to-12 vote to impose sanctions on foreign companies that help supply gasoline to Iran, in a move to deter Tehran from pursuing its nuclear program. The bill authorizes President Obama to levy sanctions on energy companies that directly provide gasoline to Iran along with the firms that provide insurance and tankers to facilitate the fuel shipments. The Senate is likely to approve similar legislation. (Reuters)
  • Britain to End Arrest Threat on Officials from Abroad
Britain pledged on Tuesday to change a peculiar legal power that permits judges to order the arrest of visiting politicians and generals, a threat currently focused on Israeli officials that could potentially be invoked against President Obama or Russian Prime Minister Putin. The latest target has been Tzipi Livni, the former foreign minister of Israel and currently the country's opposition leader. Foreign Secretary David Miliband announced that Britain would no longer tolerate legal harassment of Israeli officials by judges invoking universal jurisdiction.
Legal experts in England and Israel say "universal jurisdiction" could be abused endlessly to harass any high-profile visitor who oversaw a military or anti-terrorist operation. "Why not use this against Vladimir Putin over Russia's role in Chechnya? There is no end to it," said Yehuda Blum, a former Israeli ambassador to the UN. "The abuse and misuse of this concept of universal jurisdiction should be discontinued." Eugene Rogan, director of the Middle East Center at Oxford University, said the demands of global diplomacy required leaders to be able to travel abroad without facing arrest threats. (AP/New York Times)
  • Palestinian Leaders to Extend Abbas' Term Indefinitely - Howard Schneider
The Palestinian Liberation Organization's ruling Central Council gathered in Ramallah to extend the soon-to-expire term of Palestinian President Mahmoud Abbas. Delegates said that with little hope of elections soon, they will authorize Abbas to stay in office indefinitely. (Washington Post)
See also Hamas Rejects PLO Dominance - Nidal Al Mughrabi
Hamas served notice on Monday that it would ignore any decisions by the PLO this week about future leadership and peace talks with Israel. "Hamas will not retreat from Jihad and resistance until it achieves freedom and independence for our people," Gaza Prime Minister Ismail Haniyeh told a huge rally.
Hamas is not part of the PLO, which was founded in 1964 and is recognized internationally as the representative body of the Palestinians. "We say to PLO Central Council members" meeting in Ramallah that any decision that "contradicts the will of the people, will not be binding," Haniyeh said. The PLO is expected to extend the term of Abbas as president of the PA this week. Abbas would stay in office until elections can be held, which will require the agreement of Hamas, which does not recognize his legitimacy. (Reuters)

News Resources - Israel and the Mideast:

  • Abbas Says 1967 Borders Are Precondition for Talks - Ali Waked
Palestinian leader Mahmoud Abbas said Tuesday: "We will renew negotiations if the settlements are completely halted and the 1967 borders recognized as the borders of the Palestinian state." He also commended the European Union on a proposal to declare eastern Jerusalem the future capital of a Palestinian state. (Ynet News)
See also Israel to Abbas: We Will Not Accept Any Preconditions
"Anyone who sets such conditions is just trying to escape reality and avoid negotiations and a peaceful solution," Foreign Minister Avigdor Lieberman said Tuesday in response to Abbas' statement. "Israel will not accept any preconditions for resuming peace negotiations."  (Jerusalem Post)
See also "Abbas Moving the Goalposts" - Khaled Abu Toameh and Herb Keinon
Abbas is again "moving the goalposts" by saying Tuesday he will not negotiate with Israel until the world recognizes the 1967 lines as the borders of a future Palestinian state, Israeli diplomatic officials said. "There will be no more unilateral confidence-building measures to get to the negotiations," one official said, referring to the 10-month housing start moratorium in the settlements. (Jerusalem Post)
  • Israel, PA Debate "Starting" Negotiations - Akiva Eldar
A senior diplomatic source told Ha'aretz Tuesday there were gaps between Prime Minister Netanyahu and Abbas on the very definition of the negotiating process. Netanyahu demands the process be defined as "starting" negotiations, aiming to disregard understandings reached in talks between the Palestinians and his predecessor, Ehud Olmert. Abbas insists the process must take those understandings into consideration, and demands it be defined as a "resumption" of negotiations. The Americans propose a compromise in the form of "re-launching" the negotiations, said the source. (Ha'aretz)
  • Israel: Turkish-Mediated Talks with Syria a Mistake - Roni Sofer
Syria is responsible for the failure of peace negotiations between Jerusalem and Damascus, Deputy Foreign Minister Daniel Ayalon told the Institute for National Security Studies at Tel Aviv University on Tuesday. Ayalon said that "Syria didn't desire peace, and through these negotiations it fooled everyone in a bid to emerge from global isolation. Looking back today, we can say that the Turkish mediation was a mistake." Syria "must prove that is desires peace, not war," he said. He stressed that relations with Turkey will continue to be good, "as this is the interest of both sides."  (Ynet News)

Global Commentary and Think-Tank Analysis (Best of U.S., UK, and Israel):

  • Abbas Still Says No to Talks But Everyone Still Blames Netanyahu - Jonathan Tobin
The decision of Israeli Prime Minister Netanyahu to freeze building homes in Jewish settlements in the West Bank has earned him little credit either in Europe or among his country's Arab foes. Rather than respond to Israel's gesture aimed at re-starting peace talks, PA leader Abbas raised the ante. In other words, until the Israelis make concessions that ensure that nothing is left to negotiate about, he won't engage in negotiations.
Abbas, whose term in office will probably be extended without holding an election because his Fatah party knows it might lose to the Islamists of Hamas, has been telegraphing his lack of interest in talks all year. Given the fact that the Palestinian public still won't accept any deal with Israel no matter where the borders are set, it's not likely that this will change. Thus the conceit of Ethan Bronner's latest "Mideast Memo" in the New York Times, which ponders the sincerity of Netanyahu's desire for peace.
But the frustrating aspect of this discussion isn't so much the condescension toward Netanyahu, but rather the way the peace process is framed - in such a way as to put the entire onus on Israel to make concessions, while virtually ignoring the fact that the Palestinians continue complete refusal to accept the concept of peace with a Jewish state. Foreign correspondents based in Israel might want to pay more attention to the fact that the political culture of the Palestinians makes peace an impossibility even for their allegedly moderate leader. (Commentary)
  • The Targeting of Israeli Ministers by British Courts Is Not Justice, It Is a Disgrace - Editorial
The campaign for legal targeting of Israeli leaders is not merely frivolous: it is repugnant. It risks damaging Britain's relations with an ally, undermines the government's moral authority in promoting a two-state settlement of the Israeli-Palestinian conflict, and brings the legal system into disrepute. Israel's Gaza campaign was not a crime against humanity. It was a chapter in Israel's history of trying to stop violence against its own civilians, which is a prerequisite of achieving a two-state resolution. You cannot reasonably criticize Israel's military tactics without understanding Israel's security needs. (Times-UK)
See also Democracy Under Arrest - John Bolton
It is no accident that "universal jurisdiction" arrest warrants never seem to be issued for the likes of Kim Jong Il or Mahmoud Ahmadinejad, since their real targets these days are Western nations. (Wall Street Journal)

Observations:

Berman: Iran Sanctions Bill Empowers Obama - Laura Rozen (Politico)

  • Fresh from the overwhelming passage of the Iran sanctions bill he introduced, Rep. Howard Berman said he believed his bill would empower the Obama administration's Iran policy efforts, not force its hand. "The House passage of this legislation empowers the administration to point out that, 'Here is a way a lot of people in Congress want to go,'" Berman (D-CA), the chairman of the House Foreign Affairs Committee, said after the vote.
  • "The administration did not say, 'Go ahead,' and they did not tell me not to go ahead," he acknowledged. "And I have been as transparent as I could be with them. When I entered the bill, I said I wanted to give the diplomacy/engagement strategy a chance to work."
  • Asked if he would accept a final bill that gives the president greater discretion on the matter, Berman said he would be quite open to exempting foreign countries that are shown to have a robust sanctions regime in place from the final bill.
  • Israeli ambassador to Washington Michael Oren praised the House vote. "The State of Israel deeply appreciates the unflagging commitment of President Obama and the U.S. Congress to prevent Iran from acquiring the military nuclear capability threatening world peace," Oren said.
  • A senior White House official said that U.S. and international credibility would be hurt if they didn't demonstrate that they were serious after weeks of telegraphing the end of the year deadline for Iran to show progress on the engagement track, or face consequences.
See also Hit Iran Where It Hurts - U.S. Rep. Ileana Ros-Lehtinen (Los Angeles Times)

  • For more than ten years, Tehran has succeeded in deceiving foreign governments, thwarting nuclear inspectors and keeping sanctions weak and feckless. During that time, Iran has not broken stride in expanding its nuclear program.
  • The range and accuracy of Tehran's ballistic missiles continue to improve, with U.S. forces and allies in the Middle East and Europe now within striking distance. Iran is also quickly accumulating an array of advanced conventional weapons in its effort to dominate the Persian Gulf and the world's oil supply. Iran has assumed a major role in fueling the insurgency in Iraq and is backing Taliban militants in Afghanistan.
  • Nothing less than overwhelming and crippling sanctions could produce a reversal of its threatening programs and policies. That is why the U.S. must be prepared to act alone, if necessary, and with every weapon in its political and economic arsenal. The Iran Refined Petroleum Sanctions Act is one such tool.
  • These sanctions must be coupled with action on all fronts. The U.S. must also specifically reject Iran's claim to an inalienable right to produce nuclear fuel. We must strengthen existing laws to prevent the transfer of prohibited materials and technology to Iran. Responsible nations should impose a ban on travel by senior Iranian regime officials and their families to Europe and the U.S.
  • We should strengthen bilateral and multilateral efforts to shut down accounts of those doing business with the Iranian Revolutionary Guard Corps or its affiliated entities; deny Tehran access to euros and U.S. dollars; and freeze the assets of those who violate UN sanctions on Iran. Concurrently, we should offer our full support to the Iranian people and increase funding for Iran democracy programs.

Ileana Ros-Lehtinen (R-Fla.) is the ranking Republican on the House Foreign Affairs Committee.

The center will be co-located with the YMCA’s new 33,000-square-foot facility, and the YMCA will operate the aquatic center for the city.

"We the People..."

Tomorrow morning, the delegates at the UN climate change conference in Copenhagen will awaken to a

very simple but powerful message:

"In America, We Have a Constitution. It Begins: We the People..."

These are the opening lines of a message to the American delegates in Copenhagen and the rest of the world sent on behalf of the American people by American Solutions. They are meant as a reminder to both Obama Administration officials and international climate activists that under our constitutional system, the American people, not government bureaucrats, are sovereign.

Ronald Reagan was right when he said that America is a nation that has a government - not the other way around.

And if you have any doubt that the delegates at Copenhagen need to hear this message, take a look at this:

This is a reference guide being handed out by one of the non-governmental organizations at Copenhagen to keep track of all the proposals to reduce emissions from deforestation and degradation. It's purposefully modeled after the Chinese mass murderer Mao Tse-Tung's "Little Red Book of Communism."

Can the profoundly undemocratic nature of this conference be any clearer?

Congress Has the Power to Protect the Constitution. It Should Use It.

American Solutions' message to the Obama Administration and the Copenhagen delegates is this:

President Obama cannot bind the American people to job killing international agreements on climate change without the advice and consent of the United States Senate.

Similarly, he can't bypass the peoples' representatives in Congress by having the EPA pursue the same goals through bureaucratic totalitarianism.

This message to the President is also a message to Congress. Should the Obama Administration act unilaterally and subvert the Constitution, the American people will rightfully rise up in opposition.

Congress has the power to protect its constitutional role and protect the people's voice in how we're governed. It should use it.

Substituting the Advice and Consent of the Senate with the
Bureaucratic Power of the EPA

When he travels to Copenhagen this week, President Obama is reportedly going to pledge to reduce U.S. greenhouse gas emissions by 17 percent by 2020.

The Obama Administration's various threats to act unilaterally - both in Copenhagen and at home via the EPA - to achieve this goal occur against the backdrop of this inescapable fact: The Senate, reflecting the will of the American people, refuses to pass the administration's job killing cap and trade legislation.

The result is that the administration is preparing to bypass the Senate with its announcement last week that the EPA will regulate carbon dioxide as a dangerous pollutant .

Knowing that it lacks the votes in the Senate to ratify any binding commitment made in Copenhagen to radically lower emissions, the administration may well attempt to use the EPA's newly asserted power - thus bypassing Senate ratification - to implement the agreement.

This would be a breathtakingly anti-democratic and unconstitutional arrogation of power on the part of the President. But it is exactly what some groups are pressuring the President to do. See this report, "Yes He Can: President Obama's Power to Make an International Climate Commitment Without Waiting for Congress" by the Center for Biological Diversity Climate Law Institute.

And Congressman Ed Markey (D-Mass.), the co-author of the energy tax in the House of Representatives, stated this past weekend on "Fox News Sunday", in response to Chris Wallace's question about whether President Obama could make a binding commitment at Copenhagen, that "without question, the President does have the authority to make a commitment based upon the endangerment finding - that is the authority the EPA will have."

Such action would be a corruption of America's constitutional system that the Congress must reverse.

Does Senator Webb Believe the Authority of the EPA Can Substitute for the Authority of the Senate?

Some senators seem to get this. On "Fox News Sunday" last weekend Senator Jim Inhofe (R-Okla.) stated flatly that the President doesn't have the power to make binding emissions reductions commitments at Copenhagen.

And Virginia Democratic Senator Jim Webb recently wrote an open letter to President Obama in which he warned the President not to make binding commitments at Copenhagen.

"As you well know from your time in the Senate," wrote Webb, "only specific legislation agreed upon in the Congress, or a treaty ratified by the Senate, could actually create such a commitment on behalf of our country."

But Senator Webb wrote his letter before the EPA unilaterally declared the government's right to regulate carbon dioxide.

And so the question must be asked of Senator Webb: Does he believe that the authority of the EPA can substitute for the constitutional authority of the Senate - authority that he has so courageously defended?

Radical Environmentalism Is "The New Socialism"

Columnist Charles Krauthammer calls the shake down occurring in Copenhagen and the EPA's domestic power grab "the new socialism."

Following the death of the old socialism with the Soviet empire, writes Krauthammer, "the cultural elites went straight from the memorial service for socialism to the altar of the environment. The objective is the same: highly centralized power given to the best and the brightest, the new class of experts and technocrats. This time, however, the alleged justification is saving the planet."

And if the question is, "Will the new socialism succeed?" the answer is, "Not if the American people have anything to do with it."

The American People, United, Will Never Be Defeated

Last year, the "drill here, drill now" movement succeeded in removing both the executive and legislative bans on drilling offshore to capture American energy [www.americansolutions.com/drill].

The American people's success in "drill here, drill now" opened up a national conversation on freeing America from dependence on foreign dictators for our oil. Americans began to understand and believe that We Have the Power (see Callista's and my movie on energy of the same name) to safely develop our own energy reserves and technology to achieve energy independence.

Congress Wants to Give you $17,500

While most Americans are steamed about Healthcare and Cap and Trade, millions of folks missed Congressional Mandate HR-3221.

That's too bad, because HR-3221 contains a “secret loophole” that could pay you $17,500 this year - and every year. Click here to uncover the loophole - and get your cash...
Today, American Solutions is issuing a similar rallying cry to the American people.

Our message is that no imperial presidency, no totalitarian bureaucracy, and no global international elite can or will usurp the power of We the People.

I conclude today, the 236th anniversary of the Boston Tea Party, with the full text of our ad, which will appear in the daily newspaper of the Copenhagen conference tomorrow:

MESSAGE FROM AMERICA
TO THE AMERICAN DELEGATES IN COPENHAGEN
AND THE REST OF THE WORLD

In America, We Have a Constitution.
It Begins: "We the People"

Our Constitution Requires International Agreements to
Be Agreed Upon By our Senate

Our President Does Not Have Support in our Senate for
Binding Carbon Emissions Limits

Our Environmental Protection Agency Recently Asserted It Has the
Power to Impose Carbon Emissions Limits

Such Action would be Tantamount to our Executive Branch Taxing the American People without
Approval from the Elected Representatives in our Legislative Branch

That's Called "Taxation without Representation" and
We Will Not Stand for it

The American Revolution and a Famous Tea Party in
Boston in 1773 Was About Rejecting Taxation without Representation

We Reject Taxation without Representation even if it
is attempted by our President through an international "political" agreement like the Copenhagen 15

Through Our Election Process, our Presidents, Representatives, and Administrators Are
Accountable to the American People

Unlike Other Countries, We Do Not Have a Democracy Deficit

In America, Mesdames and Messieurs, We the People Govern

BKPG is on the move - bigger profits than gold & oil (sponsor message)

The following is a special offer for InvestorGuide Daily subscribers from our sponsor, Michael Williams Market Movers.

If the images or content below are not being displayed, please visit
http://www.setinvestment.com/BKPG/

FULL REPORT FULL REPORT

Revenues in this international phenomenon are soaring,
making it a great time to
put your money into this cash cow.

BUY BKPG.OB

Omnicom, WPP, The Interpublic Group — they're the great granddaddies of the ad industry and I assure you they're watching their backs as this up-and-coming ad agency continues its global feeding frenzy on profitable agencies.

The New Mad Men Are Taking Over a $142 BILLION Industry

Trading well below its valuation I'm urging my investing family to BUY SHARES NOW in BKPG.OB while the opportunity to make money is at an all-time high. My latest Top Stock Pick has already reported soaring revenues, up 86%!

Fellow Wall Street Watcher,

I love the ad business. When these guys spin off money, they spin it off like software companies spin off apps for the iPhone.

For the past few months I've been carefully monitoring a new agency that has all the potential to become the next great Omnicom or InterPublic Group of Madison Avenue: The Bark Group.

A force to be reckoned with, the Bark Group (BKPG.OB) is a multinational communications company with offices in Denmark, Germany and Switzerland.
In its latest strategic move, the Bark Group has opened an office on Madison Avenue's home turf, New York City — right in the heart of the ad agency game.

Explosive revenue growth -
Find out more in my
Special Report

Already the Bark Group (BKPG.OB) is on fire! The company recorded an 86 percent growth in revenue, reaching $8.0 million already... and it's forecasted to hit $227.8 million in 2012 on the current trajectory.

By end of this year, Bark management plans to acquire 5-7 more companies, reaching 12 offices by 2012 through its aggressive growth strategy. Learn more about this winning strategy in a Special Report I've created for investors.

Another reason to love BKPG.OB and the ad industry: it's a cash cow. During recessionary times cash flow is critical, and between print, broadcast and media alone, the cash flows like Niagara Falls.

Sleeper to SUPERSTAR, Bark is on the move

on a whirlwind worldwide rollup, snapping up ad agencies right and left. Now there's a catch to their acquisition-based growth strategy...

In a strategically smart move, Bark management has decided to only acquire established and profitable, cash-flow positive creative shops with a strong client base — a superior success strategy that's clearly paying off. This huge move is documented in my Special Report  I've created for my readers.

Are these guys smart or what?! This is an incredible time to buy with acquisition costs being so much lower. This will help Bark transform from a small company to a multi-million dollar, multinational corporation.

Their goal, in just four years, is to be ranked among the 10 best, most profitable communication companies in Europe. Management is smart and experienced in the business. I am confident they'll do it.

That's why buying shares today is so critical. Ground floor opportunities are the best times to make mammoth profits.

Bark is no typical agency... it's becoming the cat's meow of the industry

Here's what further caught my attention:
company management has taken the standard industry business model...and turned it upside down, making it light years more efficient.
Clients love this new innovative business model — it's one of the primary motivators attracting new clients. By the way, it is also the first of its kind that we are aware of. It won't be long before others start using it as well but Bark has the first-mover advantage.

Find all the details in a Special Online Report   I created for a very select group of investors like you.

I can tell you from what I've uncovered, the fresh and innovative approach (along with sizzling hot creative) has helped draw some big money spenders to Bark.
Already the agency has added numerous blue — chip clients to its roster, including three new account wins this year already — one of which covers 18 different countries. Take a look at some of the players that hired Bark (BKPG.OB) as their agency:

There's simply too much to detail here so I urge you
to read my Special Report to learn more and discover
10 POWERFUL REASONS
why you should invest in BKPG.OB today.

Then call your broker or go online to buy shares.

You want to have your shares firmly in hand before BARK starts to rocket up the charts.

Valued at EIGHT HUNDRED TIMES
its current share price -
Read my Report

Leading independent research and investment banking consulting firm, Westport Strategic Partners recently gave Bark's stock a valuation of $4.33 per share. Looking at the current share price you quickly see what a great time to buy this is — the new valuation is 800 percent higher.

Quick look at the profit you could pull from an early investment in BARK:

BKPG.OB
$5,000 could soar to $40,000
$10,000 could rocket to $ 80,000
$20,000 could explode to $ 160,000

Opportunities to become a shareholder in a rising star on Madison Avenue are few and far between so when they do come along on those rare opportunities, I urge my readers to start snapping up shares.
BKPG.OB-buy now!

I am convinced that the Bark Group (BKPG.OB) is going to be the next Omnicom or Interpublic Group-a darling of Madison Avenue and investors alike.

Read my Special Report  and find out why!

Does Bluetooth cause brain tumors?

QI use Bluetooth headphones with my iPod touch. I like to listen to it while walking our dog. When I told my son about the headphones, he told me to be careful. He said they can create a Bluetooth-shaped tumor in my head. Is there any evidence to support this?
—Thomas in Greensburg, PA, listening on podcast via Kim's Club

ACell phones use radio waves, a form of electromagnetic radiation. Numerous cancer studies have been conducted for cell phones. So far, they have been inconclusive.

Bluetooth headphones also use radio waves. Could they cause cancer? The jury is out. This is an area that has not been tested well.

Cell phone radio waves are stronger than those from Bluetooth devices. However, headphones often enter the ear, so are closer to the brain.

Click below for today's tip, on my site. Corded headphones are less convenient than those with Bluetooth. But they may be safer.

If you want to know what was dominating the markets today, read on:

Investors retreated to the sidelines on Tuesday as Federal Reserve policymakers gathered for a two-day meeting on interest rates. A selloff in bank shares dragged on the Dow, causing it to shed 49.05 points before the closing bell. Market breadth was mixed. On the New York Stock Exchange, losers beat winners eight to seven on volume of 720 million shares. A spike in wholesale inflation contributed to today's declines. The government said wholesale prices jumpe d 1.8 percent last month, more than double the gain analysts expected. If prices start to rise too quickly the Fed could be forced to raise rates and that could put a wrench in the economic recovery. In addition to this, the Empire Manufacturing index, a measure of manufacturing in the New York area, slumped to 2.55 in December. The disappointing reports benched some already cautious investors. U.S. light crude oil for January delivery rose $1.03 to $70.54 a barrel. The dollar rose against other major currencies, while gold prices fell.

The Federal Deposit Insurance Corp. is boosting its budget by 55 percent and will increase its work force by 23 percent as it struggles to keep up with bank closings. The agency released a $4 billion operating budget , of which $2.5 billion is to be used to fund the takeover of failed banks. The 2009 operating budget was $2.6 billion.

At last, something relevant is being taught in college: "Sidney Plotkin, a professor of political science at Vassar College...began a new section of the course by exploring the housing bubble and Bernard L. Madoff, consumer borrowing and federal bailouts - and shining a Marxist light on the whole morass."  Full Story..

David Herszenhorn sees Senate Majority Leader Harry Reid's outsized Democratic majority as "a chain around Mr. Reid's neck..."  Full Story..

And you thought "Up in the Air" was just holiday entertainment. Frank Rich tells us it's actually "using the power of pop culture to salve national wounds that continue to fester in the real world."  Full Story..
